1. Agreement to Terms

By accessing or using the Navigator Kids AI™ website, applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Navigator Kids AI™ ("Company," "we," "us," or "our").

2. Description of Services

Navigator Kids AI™ provides educational resources and tools for parents of gifted, twice-exceptional (2e), and neurodivergent children, including:

• AI-powered assessment tools to understand your child's learning profile
• Personalized activity packets and educational materials
• Parent resources, articles, and guides
• Progress tracking and reporting features

3. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Our Services are designed for use by parents and guardians on behalf of their children. You represent that you have legal authority to provide information about any child for whom you use our Services.

4. Account Registration

To access certain features of our Services, you may be required to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Membership and Subscription

5.1 Navigator Membership

The Navigator Membership is a recurring subscription service billed monthly at the rate displayed at the time of purchase (currently $99/month). Your subscription will automatically renew each month unless cancelled.

5.2 Billing

By subscribing to the Navigator Membership, you authorize us to charge your payment method on a recurring monthly basis. You are responsible for providing accurate billing information and keeping your payment method current.

5.3 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. You will retain access to membership benefits until the end of the period for which you have paid.

5.4 Refunds

We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with the Navigator Membership within the first 30 days, contact us for a full refund. After the initial 30-day period, subscription fees are non-refundable.

6. Intellectual Property

All content, features, and functionality of our Services—including but not limited to text, graphics, logos, images, assessments, activity packets, and software—are owned by Navigator Kids AI™ and are protected by copyright, trademark, and other intellectual property laws.

6.1 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. This license does not include the right to:

• Modify, copy, or distribute our content
• Use our content for commercial purposes
• Reverse engineer any software or systems
• Remove any copyright or proprietary notices
• Share your account credentials with others

6.2 Personalized Materials

Activity packets and materials generated specifically for your child may be printed and used within your household. You may not distribute, sell, or share these materials with others outside your immediate family.

7. User Conduct

You agree not to:

• Use our Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Services
• Upload viruses or malicious code
• Impersonate any person or entity
• Collect information about other users without consent
• Use our Services in any way that could harm minors

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• Our Services will meet your specific requirements
• Our Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using our Services will be accurate or reliable
• Any errors in our Services will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVIGATOR KIDS AI™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OUR SERVICES.

Our total liability for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Navigator Kids AI™ and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our Services or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of [Your State/Jurisdiction].
